ZIVA is operated by Plan with Ziva, of Des Moines, Iowa. "ZIVA", "we" and "us" in these Terms mean Plan with Ziva. You can reach us at contact_us@planwithziva.com, which is the address for every notice, question or complaint under these Terms.
1. Eligibility
You must be at least 18 years old to create an account or make a booking on ZIVA. By registering, you confirm that you meet this age requirement. ZIVA is not directed to persons under 18 and does not knowingly collect personal information from minors.
2. Nature of the Platform
ZIVA is a marketplace platform that connects event planners ("Planners") with independent venue, experience, and service providers ("Hosts"). ZIVA does not own, operate, or manage any of the listed venues or services. ZIVA does not independently verify all information provided by Hosts, including but not limited to licensing, insurance, or identity claims, which are self-reported by Hosts. Planners are responsible for conducting their own due diligence before booking.
3. Host Information Disclaimer
All amenities, capabilities, licensing status, and insurance information listed on Host profiles are provided by Hosts and represent their self-reported representations. ZIVA does not warrant the accuracy of Host-provided information. ZIVA does not carry out background checks, licensing checks or insurance checks on Hosts, and displays no badge or label that should be read as one.
4. Fees and Payments
What the planner pays. The price displayed on every listing is the all-in price the planner will pay — no additional service fees are charged to planners at checkout. Payment is taken in two parts: a deposit of 25% of the total (minimum $50) charged when the Host accepts the booking, and the remaining balance charged automatically to the card on file 30 days before the event date. If your event is within 30 days when the host accepts, there is no room for a two-stage payment, so the full amount is charged on acceptance instead.
Where payments go. Payments are processed by Stripe and are received into the Host's own Stripe account, of which the Host is the account holder. ZIVA does not take custody of, hold, or control Planner funds at any point; ZIVA's platform fee is collected from the payment at the time it is charged. ZIVA does control when a Host's funds are paid out to their bank account, and does not release that payout until 72 hours after the event has taken place. Refunds owed under section 5 are returned to the Planner from the Host's Stripe account balance. Each Host separately agrees to Stripe's Connected Account Agreement, including the Stripe Services Agreement, as a condition of receiving payments through ZIVA.
Platform fee. ZIVA charges the Host a platform fee, deducted from their payout: $8.00 flat for bookings under $100; 13% for bookings $100–$4,999.99; 10% (capped at $2,500) for bookings of $5,000 or more.
Payment processing fees are non-refundable. Stripe charges a processing fee of 2.9% + $0.30 on each payment. Stripe does not return this fee if a payment is later refunded, so it is borne by the party receiving the funds in every case:
- Where a booking completes, the processing fee is deducted from the Host's payout, in addition to the platform fee.
- Where a planner cancels, the processing fee attributable to the refunded amount is deducted from the refund.
- Where the Host cancels or fails to perform, the planner is refunded in full, including the processing fee. ZIVA advances that fee and recovers it from the Host by deducting it from their next payout.
- Where a settlement is split between planner and Host, the processing fee is apportioned between them in proportion to the amounts each receives.
ZIVA's platform fee is never reduced by processing fees. Hosts therefore receive a net payout equal to the booking total less the platform fee and less payment processing fees. Payouts are released 72 hours after the event, once the planner has had the opportunity to raise any issue, via the Host's connected Stripe account.
All fees are disclosed to Hosts during onboarding and before listing publication, and to planners before booking. Payments are processed by Stripe, Inc. ZIVA does not store payment card data.
5. Cancellations and Refunds
One cancellation policy applies to every booking made through ZIVA. Hosts do not set their own terms.
Where a Planner cancels:
- More than 90 days before: Everything back, less the card fee.
- 30–90 days before: The host keeps 25% of the booking. Everything beyond that comes back, less the card fee on the amount refunded.
- Less than 30 days before: The host keeps 25% of the booking, plus 50% of the rest. The remainder comes back, less the card fee on the amount refunded.
- On the day, or after: The booking can no longer be cancelled. If something goes wrong, report a problem instead.
Booked inside 30 days: Charged in full on acceptance and not refundable — nothing comes back, whenever you cancel. You are told this before you pay. (This rule replaces the three above for those bookings.)
Card processing (2.9% + $0.30) is charged by our payment provider and is not returned on a refund, so a "full refund" is what you paid less that fee.
If the host cancels or doesn't turn up, you get back every cent — including the card fee. That is on them, not you.
If we can't collect the balance by 21 days before your event, the booking is cancelled and the deposit is not refunded. We try 4 times and email you each time, and you can pay by hand with a different card at any point.
The Planner must accept this policy at the point of booking. The policy version in force at that moment is recorded against the booking together with the time of acceptance, and those terms govern that booking for its whole life. A later change to this policy does not apply retroactively.
6. Limitation of Liability
To the maximum extent permitted by law, ZIVA's liability for any claim arising from use of the platform is limited to the amount of fees paid to ZIVA in the 12 months preceding the claim. ZIVA is not liable for the acts or omissions of Hosts, for property damage, personal injury, or any event that occurs during a booked experience.
7. Dispute Resolution
You agree to contact ZIVA support before initiating any legal proceeding. Disputes not resolved informally will be subject to binding arbitration under the rules of the American Arbitration Association, on an individual basis. You waive the right to participate in a class action.
8. Governing Law
These Terms are governed by the laws of the State of Iowa, without regard to conflict of law principles. Any dispute not resolved under section 7 is subject to the exclusive jurisdiction of the state and federal courts located in Polk County, Iowa.
9. Changes to Terms
We may update these Terms from time to time. Continued use of the platform after notice of changes constitutes acceptance. The current version is always the one shown here, and is reachable at any time from the Terms of Service link on the sign-up screen and in the site footer.
10. Early access
ZIVA is new. The platform is in early access, and it is provided as is, without warranties of any kind to the fullest extent the law allows. Features may change, and some may be withdrawn.
ZIVA is a marketplace. The booking is an agreement between the Planner and the Host; ZIVA is not a party to it, does not deliver the service, and does not supervise it.
Payments are processed by Stripe and are held and released on the terms set out in sections 4 and 5. Those terms are unchanged by this section.
We may pause new bookings, or pause the service, if something needs fixing. If we do, we will email you at the address on your account, and any booking already accepted will be honoured or settled under section 5.
